Today on Route 80 in Pocono Township, Pennsylvania, there was a car accident involving a vehicle and tractor-trailer. Though the details have not been released on who was at fault, there was 1 fatality. The road was expected to be closed for several hours due to the accident, and 5 people were quickly transported with injuries to Lehigh Valley Health Network Pocono.
Our condolences go out to the victim and injured in this terrible Sunday morning accident. Unfortunately, accidents involving vehicles and tractor trailers happen at alarming rates all throughout Pennsylvania, which is why many laws are being introduced for trucks and big-name companies to abide by, and safety measures put in place for those who share the roadways with these large vehicles.
In these accidents when one person is killed due to the negligence of another, it is important to be able to determine who was at-fault for the accident. Though we are still unsure of the details regarding this Sunday morning accident, we have seen a variety of cases where negligence was cut and dry, and it was easy to discern who had acted negligently and caused the fatal accident: whether by texting and driving, driving fatigued, or not abiding by traffic signs or lights. When another person’s misconduct causes the death of another, this becomes a highly serious case that could lead to a wrongful death action.
Wrongful death suits are filed by a representative on behalf of the survivors who suffered from the death of their loved one. This means that the parties interested in bringing a suit must have suffered financially or emotionally due to the lost of their loved one, such as a child losing their parent’s income, or parents not being able to cover funeral expenses by themselves. Economic and noneconomic damages are usually standard in these cases. This means that you may be entitled to pain and suffering for the emotional turmoil the accident and fatality has caused in your life.
These cases can quickly become complicated matters, which is why you should always have a trusted attorney on your side through it all. If a loved one has been killed due to the negligent actions of another, you may have a claim. At Edelstein Martin & Nelson, we understand how serious these cases are and the financial and emotional effect they can have on your life. Call us today for more information at 888-208-1810.
