The other day, we posted about an accident involving a black Honda minivan and a red Toyota pickup truck. The collision caused one person in the minivan to lose their life. We now have more information about this crash and it has been determined that the fatality was that of an 8-year-old child. Six others, including a 12-year-old girl, were injured seriously in the accident involving the 2 vehicles. As of now, the 8-year-old female’s name is being withheld while her family is being notified. The minivan was driven by 40-year-old Vikas Khanna and attempted to pass a white box truck directly into a pickup truck driven by 50-year-old Jeffrey Haas.
What happens when you lose a loved one to a child wrongful death case? Nobody ever expects to lose a child at a young age that was supposed to grow up into a young adult and onward. In a wrongful death action, the value of the victim’s life is determined by the earning potential as well as the effect that it will have on the lives of everybody who was closest to this family member. It is impossible to imagine how you can determine the finances you deserve when a child has been killed in an accident and how you will move forward during this difficult time.
When a child is killed in one of these horrific accidents, a parent’s ability to recover is limited to their financial loss. There are other losses considered as well, like the age and life expectancy of the child, their state of health, earning potential, the relationship of the decedent to those claiming losses, and more. The younger the child, the more difficult your case can become because it is so difficult to accurately measure a young child’s earning potential and more.
